DogzRule Posted November 8, 2014 Share Posted November 8, 2014 Hi Guys Just wondering if anyone can provide me with legal advice in relation to this matter Three weeks ago my next door neighbor( who is renting) left her home and is staying somewhere else ( I dont know why) and she isnt allowed dogs. She left in the backyard a young 6month old puppy. She was returning every couple of days to collect clothes but I dont know if she was feeding the pup. So, I did. Under the fence I would give it water and kibble, well it dug a hole and came over, as you do lol. A couple of days later she returned and I told her the pup was safe in my yard, she came over and proclaimed her love for the pup (lie), how she walked it and fed it all the time (lie) She said where she was staying wouldnt allow dogs, I said I would mind it until she could take it back. She asked me not to walk it or introduce it to anyone ??? She wanted it aggressive and kept going on about how expensive she was !!! Anyway to cut a long story short, she has visited three times in total and I havent seen her in a week, no mention of helping with care or food etc. Im falling in love with this pup. I want to keep her and train her but I cant because I dont own her. I dont know if she has had any needles, she is very thin so may have worms. She is such a beautiful gentle soul who just wants a family and love My question is how can I keep her I would presume she is microchipped in her name and the vet has already said (over the phone) that I would have to surrender her. I personally feel that she is taking advantage of you and using you as a way to keep a dog that she cannot care for herself. No responsible owner would contemplate leaving the dog alone in the yard as a viable option, nor expect a neighbour to take care of it and feed it for free. You could get the vet to scan for a microchip and check with the council if the dog is registered, however ultimately the dog belongs to someone else, however irresponsible and undeserving she might be. I would call her bluff and ask if she can come and collect it. I'm guessing that her answer will be excuses, at which point you can offer to take the dog off her hands and if need be, offer to buy it. Link to comment Share on other sites More sharing options...
kelpiecuddles Posted November 8, 2014 Share Posted November 8, 2014 Yep. I think you need to bite the bullet and tell her it's either her dog or yours and that she needs to come get it. Unfortunately there isn't really another way around it. Maybe tell her that since it's staying at your place you need to have it friendly so you need to be socialising it now too. If the dog is not chipped, she probably won't even realise what's happening until you are the legal guardian, and if it is, let's see how keen she is to pay money to get the dog back from the pound. The other options are waiting her out, or directly pulling her up on her behaviour and demanding she do something. It's not a nice situation to be in This is probably the best solution, the hold time in Vic is 8 days, so if she doesn't check her mail in a week you can return to the pound and collect her, or follow her through to wherever the dogs from the pound go to be rehomed, and she can be desexed before being adopted out to you. If the pound would be Lost Dogs Home then I would absolutely not do that, as there's every chance they may not put the dog up for adoption if it is isn't bombproof (very few dogs even make it to the adoption floor). DogzRule Posted November 8, 2014 Author Share Posted November 8, 2014 I have just sent my local pound an email asking holding times and a I WILL PAY UP FRONT (lol) fee. I will see what they come up with. I doubt very much she would save her from the pound when she was only ever feeding her a handful of necks ?? May I ask what breed of dog it is? $3000 seems alot of money. Gee if I paid that much (and even if my dog was a giveaway but that's beside the point) I would not be leaving it alone in a empty property for someone to possibly steal.
