Rebbecca Posted April 24, 2012 Share Posted April 24, 2012 Hi guys, I was wondering if someone could please shed some light on my situation. We have a bullmastiff cross bandog, he is only a year old. I have done everything right by the council, he is micro chipped, and registered. He has a secure fence, ect Rocksteady is the most placid dog probably in our town, ( across the roads fox terrier thing is probably more vicious) he loves kids, cuddles and as much attention one person is willing to give, big smoocher!!! Yesterday we had the local council ranger come past our place, with a piece of paper, declaring rocksteady a dangerous dog. We has never gotten out, never gone for a person, and doesn't even bark at ppl walking past... If anyone was planning on breaking into our house, well he would happily invite them in!!! The ranger stated that they will be taking more action against us, but we are totally stumped on what grounds they have. We plan on fighting this, as there is no way known they are taking him. They have given us no explanation as to why... Which concerns us. Although it was mentioned that bandogs are illegal.... I checked with the council when he was registered and the answer we got was that they were not. Has anybody else had this problem? Or can give us some advice? Sorry I'm not really any help but I would be demanding to know why they are doing this. I would also get legal advice. Good luck. Sorry I don't know the QLD legislation, only NSW but you have a right to know what the allegations are against your dog so that you can defend yourself/your dog against them. Is it based on breed (i.e have they decided that he is a pit bull)? If not, then something has allegedly happened to bring about the order and you need to demand an explanation from them. Don't let up - call them constantly until you speak to someone. If QLD is anything like NSW you will have a finite amount of time to defend your dog/situation. mantis Posted April 24, 2012 Share Posted April 24, 2012 My beautiful boy who has now crossed the rainbow bridge, was a Bandogge. They are a cross of usually a Neo Mastiff & Amstaff or APBT. I suggest you talk to your ranger, I was on very friendly terms with mine, he came & did a temperament test on Kenny & said the only danger he posed to people, was licking them to death. They are very strong willed though, so training & letting them know you are the boss is essential & lots of socialisation. Please post a pic of your baby. Google Pit bull puppies and see just how many come up and how much people are paying from them ;) It's not really a good indication of whether a breed is banned or not but all you have to do to be sure is look at the legislation and 'Bandogs' are not on any of the lists Australia wide from my understanding. However - is a bandog not a cross breed that is made up of Pit Bull and various other breeds? If so, maybe they are declaring your dog restricted based on this? dogsaremyworld Posted April 24, 2012 Share Posted April 24, 2012 (edited) From what i can gather a bandog is a cross-breed that is usually Mastiff-something x but a large proportion of them are from APBT crosses, so I would imagine if there are no complaints, or no incidences then it has to be a breed based declaration. As others have said, legal advice may be the way to go. Im not sure in Queensland, but in this state you are legally entiltled to be told why the declaration was given, and are given an opportunity through the courts to tell your side of the story. I obviously don't know what mixes your particular bandog is made up of, but if it is primarily APBT, and that is what the declaration is concerning, it is my belief that you aren't allowed to bring one into the country, but mixes are still acceptable (except in Victoria of course). But I could be wrong, as I have also heard that owners of 'dangerous breed's in any state are responsible for declaring them a dangerous dog, and affixing various signposts,etc. On the QLD government website it says this: Under the Commonwealth Customs Act 1901, local governments can prohibit certain breeds (or cross breeds) of dogs in their jurisdictions, under a local law. The decision to make such a local law is at the discretion of each local government, the minister and state government have limited powers to intervene in local government laws. Here's a link to that page, so you can check out for yourself if you can find anything in it which may apply to your dog. PS Absolutely LOVE his name!!!! I did read a local story in the paper they are cracking down on dangerous dog ( dangerous breeds) but it makes no sense without a compkiant.. Could a neighbour have complained ? some people are petrified of some breeds and may have conplained just because they think your dog is a pity or something similar.. redangel Posted April 24, 2012 Share Posted April 24, 2012 Having googled Bandogs I can see there a reasons why the red flag went up at council registration : they are linked to the Pit Bull gene wise in their lineage. As a restricted breed they may be investigating on account that it may be a Pitbull by another name. Yes that is an unfair assumption but I guess a name is just that a name unless proven otherwise. If you were here in Vic where appearance is the defining judgement it seems you would most likely have no recourse. Well our dog is registered as exactly what he is, a bandogge x bullmastiff, and some say they not illegal, some say they are. Who knows. Qld is such a backwards state!
