A MAN who killed his pet dog by beating it and throwing it in a swimming pool has been fined $3000.

Kenneth Williams Jenkins, 57, of Pullenvale, put a dive belt on golden retriever Gracie before bashing her head with a chair leg and dumping her into his backyard pool, the Brisbane Magistrates Court was told today.

RSPCA lawyer Mark Alexander said the incident happened on September 28 last year shortly after Gracie returned home from the vet where she was treated after being hit by a car.

The court was told when Jenkins arrived to collect her, the dog was bright and alert and hopping around on three legs.

However, Jenkins told vet staff to remove medication from the account because it would not be necessary.

He then took her home and killed her, the court heard.

When questioned by RSPCA officers, Jenkins initially said Gracie had drowned while being given a bath.

Today he pleaded guilty to one count of animal cruelty.

Defence lawyer William Crane rejected submissions that Jenkins had been callous, saying he was "a good and decent man" whose behaviour had been inexplicable on that day.

Magistrate Jacqui Payne told Jenkins his actions were against community standards in relation to the treatment of animals.

She accepted his behaviour was not sadistic after hearing submissions he had been trying to put the dog out of its misery.

Jenkins sobbed in court as he was fined $3000, half of which will be paid to the RSPCA.

I was so angry when I read this. And the judge didn't think he was "sadistic" - what do you call it when people do this to defenceless animals? Would she consider him evil or wicked if not sadistic?

I hope his newly diagnosed prostate cancer is long and agonising before he finally gets to hell, he deserves nothign less.

I can't understand the Magistrate's logic in saying that the intention was not sadistic and Jenkins "lacked judgement on the day". What??? The defence lawyer said that Jenkins "was just trying to put the dog out of its misery". It beggars belief that a lawyer would think that anyone would believe that as Jenkins had medication removed from the vet bill "because it wasn't necessary". Now the fact that your business went under in the floods is supposed to excuse this type of horrendous behaviour?? What a creature!

Sick no reason to do if he didn't want the dog to suffer he should has taken the meds :@ or even drop the dog of at a rescue center where he has a chance to find a good home or if they don't at least he would be put down humanly if you can't afford to look after him. It's so rare to get a good judge wish there where more out there

What on earth was in those convoluted submissions saying he was trying to put the dog out of it's misery?!

There was most definitely intent there, he had enough forethought to tell the vet to take the meds off the account, "won't need them" before taking Gracie home and committing this heinous act. Did he also leave other treatments unpaid?!

Who puts a dive belt on their dog when they're bathing it in the pool.. (and who would think anyone else would actually believe the dog drowned in a bath..)

If he wanted the dog "out of its misery", surely he could've just taken it back to the vet.. Clearly the killing of the dog was premeditated so it should've been judged accordingly.
