I wouldn't of paid full price for the pup until a contact was infront of me and I agreed.

However if it was my dog. I would allow them to use the male for no cost if they paid for all health tests. Realistically that situation would have an advantage for me as I would then have a fully health tested dog and it didn't cost me a cent.

The other way would be I would do all the health testing - which if I had the dog for breeding or potential stud use I would need to do it anyway. I would then charge the breeder the full amount for a normal stud fee for my breed.

sounds funny that they paid for the puppy in full and didnt know what the terms and agreements were! pays to always check before paying in full, somebody could get hurt here, but I hope it all goes well for the puppy!!! :laugh:

And if the breeder's decide o legally co-own; get in writing and signed exactly what age the dog will be bred at (or by), how many litters, what constitutes a litter (one or more live pups at birth, at eight weeks) etc. Will the dog need to be desexed after this or will the buyer have full rights to the dog outright on the main register, including all health testing paperwork?

If she's going to go down the breeding rights track, make sure she thinks of every single question she can, and gets all the answers in writing, and fair.

Also, should the contract become void or breached, who will have legal right to the dog and papers?

I dont pay for breeding access to the best male pups I've bred.

It's not negotiable. If an owner wont allow me free breeding access to my best male pups (ie the one that go on Main Reg)

then they have to consider another pup.

I would pay for collection expenses but no stud fee.

Health testing costs would be shared.

That sounds fair as well though Lilli, they know that is a condition of purchase, you pay for collection and half the health tests. They get a half health testing expenses paid for. I guess also only people who are willing to have an entire breeding male will purchase one with those conditions as well.

It would also depend on how many times they wanted to access the male. If they wanted 15 matings and no payment for me I might decided that is far too many.

Where as one to 3 or four might not bother me too much.

Each to their own, most important thing is it is sorted out well before the puppy is paid for or purchased and taken home.

The puppy's papers and the puppy itself will be soely owned b the the owner. Apparenty the breeders just want semen collected from him once, becase the breeder only breeds the best dogs possible and doesnt want any of their lines to die out so to speak

Sad that shes already paid the money with out asking the questions, silly really!

Personally I wouldnt go into a deal like that, I mean they are basically saying you do this or we dont give papers and thats BULL they should give papers regardless, any ethical breeder wouldnt be handling this situation like this.

Actually; If she's already paid for the pup as a main register, and THEN was told about the breeding and papers being held back, the breeder is in the wrong.

The buyer can go to fair trading, as it is not what she paid for.

Exactly she should get papers as she has paid for them but the breeder is basically black mailing her.

As for fair trading, how many times have we all read here ond DOL about how fair trading cant do jack? And also how many times have we heard the I got my puppy now I dont have papers! I'd bet serious moo-lah that this is how this will play out!

These breeders sounds very dodgey and Id be requesting my money back and hope to hell they return it! Lets face it, if they can sit there now and say either you sign this contact or we dont give you papers (blackmail) what else are they capable of? :o

Sammy Ballerina raises a good point here.

Perhaps if they are unethical enough to withhold already paid for papers, which are required to be handed over according to our controlling councils, what else are they cold enough to do?

I'm wondering if this dog will be eight years old and still entire, because the breeder's haven't gotten "what they wanted" from the dog, whilst the dog's already sired 5 litters and given the breeders more then his purchase price back to them tenfold.
