Co-ownership In Victoria

I have recently acquired a puppy in co-ownership with the breeder. She is in SA, I am in Vic. She sent across his registration with her details filled out on the back and signed, all I had to do was fill in my part, sign it and send it off with a cheque. Which I did.

Now I have been sent another form from DogsVic, "Syndicated Dog Details" which we both have to sign and send back, plus our written and signed syndication agreement. I am going to sign everything and send it off to the breeder, but what needs to go in the written agreement? Do we just put that the dog resides with me and the breeder has access to him for the purposes of her breeding program? Do I need to add anything about agreed costs?

The breeder co-owns another pup with someone in SA and she didn't have to do any of this.

I spoke to her last night, she is happy for me to type it up and sign it then post it to her, but I need to know what to write first. I don't want it coming back again because it's not correct and I can't find anything about co-ownership on the DogsVic website.

I have the form in front of me and it is self explanitory.....you are the Nominee where the dog lives and the Syndicated owners name and addresses to list under Other Owners......It probably is best if doubtfull in any way to have a contracted agreement between you both. Your breeder is an honest person (I do know her:))) but to be clear on each others obligations.....put it in writing....

When in doubt Dogs Victoria will assist in your decision making....

I'm sure Linda will go with whatever you come up with....that's the kind of person she is (trusting).......but you should really be talking to her or someone whom has a standing agreement with her.

Yeah, we've already figured out our agreement, but I thought it was between us and didn't realise we needed to present it in writing to DogsVic. It just means the transfer is more complicated that going from one name to two.

Yes I was a little surprised when this turned up as well, I already had a typed contract signed by me and other party so i just photoy copied and added to the paper work.

Its basicaly the agreement between you and other person on paper, i guess it is good a third party hold a copy so all are aware all parties have signed and read paperwork and it cant get 'lost'

I emailed Dogs Vic when I went through this a couple of years ago and this is what I was told:

With the written conditions of the syndicate they can be as simple or complex as you wish. Some syndicate members send in very brief written conditions that basically state all signatures required for all transactions, except show entries and that’s it. Whereas some other syndicates have furnished pages of conditions, even down to what food the dog should be fed and how often the dog should be groomed !!!

What you need to do is look at what situations may arise in the future that would require agreement by the syndicate members and draw up conditions around that. For example, if the dog is male & is going to be used at Stud, who will receive the stud fee / what percentage, that type of thing. Just remember that once a dog goes into syndication all members own the dog equally and all signatures will be required to amend the conditions at a future date.

Well explained :laugh: I co-own a few dogs and some of the agreements are basic where as the latest one is a bit more in depth i.e the dog is to reside with...., who recieves the stud fee, what's to happen to the dog if the primary person no longer wants it, who pays for the care of the dog, etc.
